Safe Harbor
In 2000, the U.S. Department of Commerce (DOC) and the European Commission agreed to create another means by which U.S. companies could adequately transfer personal data from the European Economic Area to the United States. Membership in this ‘Safe Harbor’ from the European Directive on Data Protection is voluntary and open to US-based companies in sectors regulated by the U.S. Federal Trade Commission or U.S. Department of Transportation.
Companies participating in the Safe Harbor have reported improvement in their ability to market to European clients. As the Safe Harbor has grown in visibility in Europe, more companies are requiring their U.S. counterparts to demonstrate membership in the program as part of their project due diligence.
